Purchases Information

Examples: Credit card number (last 4 digits), email address, name, postal code, country. Any payments made via our Services are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our Services, but we may receive information associated with your payment card information (e.g., your billing details).

Means & Purposes of Collection:

We collect this information from our third party payment processor, Stripe, when you purchase Fetch Kitty AI services such as an extracting and monitoring subscription plan. This information allows us to calculate any sales tax due in your country, to send you an invoice, to detect fraudulent credit card transactions and to communicate with you regarding your purchase.

Legal Basis: The processing of your information is necessary for the performance of the contract between you and us.

Please note that we may also collect and use your information for any other purpose permitted or required by law. We may also generate anonymized or aggregated information, which we use for our business or product purposes at our sole discretion. This is necessary for the purposes of the legitimate interests pursued by us in algorithms and services and contributing to improving our services.

We do not retain your information obtained through Google Workspace APIs to develop, improve, or train generalized AI and/or ML models.

3. How do we share your information?

We share your information with third parties where necessary to fulfill the purposes identified above, including as set forth in the table below:

Service providers: We may share your information to our authorized third party service providers providing us services such as payment processing, website hosting, marketing, recruitment or data storage. We limit the information provided to these service providers to that which is reasonably necessary for them to perform their functions, and our contracts with them require them to maintain the confidentiality of such information in compliance with applicable laws.
Some service providers we use in the course of our activities include Amazon Web Services (cloud services), Auth0 (user authentication services), Close.com (CRM software), Stripe (payment processing services), and Segment (customer data platform).

Professional Advisors: We may share your information to our legal, financial, accounting or other consultants to the extent necessary to operate our business and comply with applicable laws.

Law Enforcement and Other Authorities: We may receive requests by authorities to access your information. We will validate that the request is licit before responding. When possible, we will advise you. We will only share what is strictly required.

Commercial Transactions: We may share your information with an acquirer, successor or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

Fetch Kitty AI does not engage in cross-context behavioral advertising. We do not share your personal information with third parties for the purpose of showing you behavioral advertisements across different contexts, such as across different websites or apps. Our use of your information for advertising purposes, if any, is limited to contextual advertising based on your current use of our Services.

Except as provided in this Privacy Policy, or subject to applicable laws, we do not disclose any information to third parties.

4. How do we transfer your information?

We are based in the province of British Columbia, Canada. Your information may be held at our offices and accessed by our employees and full-time contractors, and those of our third-party service providers, and professional advisors (i.e., Canada, United States) as described above. Some of these third parties may be based or share your information outside of your region. By submitting information to us, you consent to the communication of your information to, and the storage of that information, outside of your region. While such information is outside of your region, it is subject to the laws of the jurisdiction in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other jurisdictions pursuant to local laws. However, our practices regarding your information will at all times continue to be governed by this Privacy Policy.

Where applicable, we comply with legal requirements providing adequate protection for the transfer of information to third countries. For example, if you are in the European Union, we are required to ensure that appropriate safeguards are in place prior to transferring your information out of the European Union, and we do so through standard contractual clauses or through other safeguards when they are available.

5. How do we secure and keep your information?

We implement appropriate physical, administrative and technical safeguards designed to preserve the confidentiality, integrity and security of information under our control. In addition, we use third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run our Services, and these third parties have been selected for their reliability in terms of security, both electronic and physical. However, information transmitted on the Internet and/or stored on systems attached to the Internet is not 100% secure, and no security can provide absolute protection. As a result, we do not ensure, warrant or guarantee the security or integrity of such information.

We retain your information only for as long as is necessary for us to fulfill the relevant purposes specified in this Privacy Policy and to comply with our legal obligations. If you want to delete your Fetch Kitty AI account, you can go to the section "Account Settings" of your profile and click on the option "Delete your account."

We take steps to ensure that only those who need access to your information to perform their duties have access to it.

6. What are your rights regarding your information?

Under certain circumstances and subject to applicable data protection laws, supported by a written request and proof of identification, you may consult the personal information that we have collected, used or shared, and/or ask that it be corrected, and/or withdraw your consent to our disclosure or use of personal information collected.

As required or permitted by law, you may be entitled to additional rights, including: (i) the right to withdraw consent to processing where consent is the basis of processing; (ii) the right to object to unlawful data processing, under certain conditions; (iii) the right to erasure of personal information about you, under certain conditions; (iv) the right to demand that we restrict processing of your personal information, under certain conditions, if you believe that we have exceeded the legitimate basis for processing, that processing is no longer necessary, or that your personal information is inaccurate; (v) the right to receive computerized personal information collected from you in a structured, commonly used and technological format and to have this information transferred directly to another organization; (vi) the right to be informed of and submit observations regarding automated decision-making; and (vii) the right to request information about data processing. You may also, where applicable, have the right not to receive discriminatory treatment for the exercise of your privacy rights.

Finally, you also have a right to lodge a complaint with a competent data protection authority, in particular in the country/territory where you normally reside, where we are based or where an alleged infringement of data protection law has taken place, such as the Office of the Privacy Commissioner of Canada, the Office of the Information & Privacy Commissioner for British Columbia or theCommission d'accès à l'information du Québec.

7. Children's privacy

We do not knowingly collect personal information from children under the age of 14 on our Services. If you are the parent or legal guardian of a child under 14 who has provided us with personal information, please contact us as set forth in the section below "How to contact us?" to ask us to stop using or to delete that information.

8. How to unsubscribe to our communications?

If at any time you wish to stop receiving communications from us, we include an unsubscribe mechanism in all of our emails or you can contact us as set forth in the section below "How to contact us?" We offer you the option to manage your subscription preferences to select which kind of communication you do not want to receive (e.g., notification emails related to your account activity and educational, product updates and promotional emails).

For Fetch Kitty AI account holders, you can also go to the section "Account Settings" of your profile to unselect the option "I'd like to receive product updates" in order to unsubscribe from product update newsletters.

Please keep in mind that if you choose to unsubscribe from all Fetch Kitty AI communications, you may continue to receive transactional or account communications related to your subscription plan or other services that you have requested on our Apps.

9. What cookies do we use?

Cookies are a small piece of text that is placed on your computer when you visit a website. Cookies are used to save information between visits to a website, such as your browsing patterns, language preferences, and login information. 10. How will you know this Privacy Policy has changed?

From time to time, we may update this Privacy Policy. Any changes will be effective when we post the revised Privacy Policy. Your use of our Apps and Services following the posting of any changes to the Privacy Policy constitutes acceptance of those changes. This Privacy Policy was last updated as of the effective date listed at the top. Subject to applicable laws, we will notify you of any changes to this Privacy Policy.

12. Information for California Residents

This section supplements Fetch Kitty AI's Privacy Policy and applies solely to individuals who reside in the state of California.

Fetch Kitty AI collects information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("personal information"). This Privacy Policy applies to all personal information we collect, including information related to our employees and data collected in business-to-business (B2B) transactions. As of January 1, 2023, in compliance with the California Privacy Rights Act (CPRA), employees and B2B contacts have the same rights as consumers with respect to their personal information.

Sensitive Personal Information

We collect, process, and disclose login credentials, which may be considered sensitive personal information under California law, solely for the purpose of providing our Services as reasonably expected by an average consumer who uses those Services. Specifically:

  • We collect login credentials (including usernames and passwords) only when necessary to perform the Services you have requested, such as when you create a data extraction robot that requires access to a specific website.
  • We use these login credentials exclusively to provide the Services you have explicitly requested and reasonably expect us to perform.
  • We do not use login credentials or any other sensitive personal information for any purpose other than providing our Services, as permitted by Cal. Civ. Code § 7027(m)(1).
  • We do not sell, share, or use login credentials or any other sensitive personal information for advertising purposes.
  • We implement strict security measures, including encryption and access controls, to protect your login credentials from unauthorized access or disclosure, both within our systems and during any necessary transfers to service providers.

While California law generally provides consumers the right to limit the use of their sensitive personal information, in this case, the use of login credentials is necessary to provide our Services. Therefore, it is not possible to limit the use of login credentials without impacting our ability to provide the Services you've requested.

We will update this policy if our practices change regarding the collection or use of sensitive personal information. How Long We Retain Your Information

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, as described in this Privacy Policy, unless a longer retention period is required or permitted by law. The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide Services to you.
  • Whether there is a legal obligation to which we are subject, for example, certain laws require us to keep records of your transactions for a certain period before we can delete them.

Who We Disclose Personal Information To

  • Service providers: We may disclose your personal information to service providers who assist us in providing our Services, such as payment processing, website hosting, marketing, recruitment or data storage.

  • Law enforcement: We may disclose your personal information to law enforcement agencies in response to a lawful request or subpoena.

Your Privacy Rights

California law provides consumers with specific rights regarding their personal information. This section describes those rights and explains how to exercise them.

  • Access to Specific Information and Data Portability Rights. You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:
  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • Right to Delete. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
  • Right to Correct. You have the right to request that we correct inaccurate personal information, considering the nature of the personal information and the purposes for processing the personal information.
  • Right to Opt Out of the Sale and Sharing of Personal Information. You have the right to opt out of having your personal information shared for personalized advertising purposes or sold. We do not share personal information for personalized advertising or sell personal information.
  • Right to Opt Out of Automated Individual Decision making. You have the right to not be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you. We do not engage in automated individual decision making.
  • Right to Limit the Processing of Sensitive Personal Information. We do not process the sensitive personal information of California residents beyond what is necessary to perform the Services or provide the goods reasonably expected by an average consumer who requests our goods and Services.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of these rights.
  • Rights Under California's "Shine the Light" Law. Civil Code Section § 1798.83 permits California residents that use our Apps to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.

Selling Personal Information

In the preceding twelve (12) months, Fetch Kitty AI has not sold personal information, or shared personal information for cross-context behavioral advertising purposes.

Verifiable Consumer Requests

Your verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected information and describe your request in sufficient detail that allows us to properly respond to it. We cannot respond to your request if we cannot verify your identity and confirm that the information relates to you.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent, please contact us via the methods noted above. If you are a California resident, you can designate an authorized agent to make a request on your behalf only if: (1) the authorized agent is a natural person or a business entity registered with the Secretary of State of California; and (2) you sign a written declaration that you authorize the authorized agent to act on your behalf. If you use an authorized agent under California law to submit a request to exercise your rights, please have the authorized agent take the following steps in addition to the steps described above:

  • Email a copy of your signed written declaration authorizing the authorized agent to act on your behalf; and
  • Provide any information we request in our response to your email to verify your identity. The information requested will depend on your prior interactions with us and the sensitivity of the personal information at issue.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

If you provide an authorized agent with power of attorney pursuant to California Probate Code sections 4121 to 4130, it may not be necessary to perform these steps and we will respond to any request from such authorized agent in accordance with the CCPA.

California, Iowa, Kentucky, Tennessee, Texas, and Virginia residents may make a verifiable consumer request twice within a twelve (12) month period, free of charge, unless the request is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. Colorado, Connecticut, Delaware, Indiana, Montana, New Hampshire, New Jersey, Oregon, and Utah residents may make a verifiable consumer request, free of charge, once within a twelve (12) month period; subsequent requests from residents in these states may warrant a fee.

Virginia, Colorado, and Connecticut, you have the right to appeal our decision regarding your request to exercise your privacy rights. To submit an appeal, please contact us atprivacy@fetchkitty.com with the subject line "Privacy Rights Appeal" and provide details about your original request and why you believe our decision should be reconsidered.
